1. Ownership of Site and Content

HotelsMapping owns and operates the Site. HotelsMapping, its licensors or its third-party content provider partners are the owners of all material displayed or featured on the Site, including, but not limited to, text, graphics, data, photographic images, moving images, sound, illustrations, software and the selection and arrangement thereof ("HotelsMapping Content"). HotelsMapping Content and all other elements of the Site are protected by copyright, trade dress, moral rights, trademarks, and other laws relating to the protection of intellectual property.

2. Authorized Licensees of HotelsMapping Content

The "HotelsMapping Content" consists of the hotel and travel related text, data, images, videos, and other media that HotelsMapping distributes to its distribution clients who have signed a valid distribution licensing agreement with HotelsMapping (“Authorized Licensees”) and are, therefore, authorized to use HotelsMapping Content in accordance with the license agreement.

Any use of HotelsMapping Content by a party ("User") is subject to the following requirements and restrictions, unless specifically stated otherwise in an Authorized Licensee's written agreement with HotelsMapping:

HotelsMapping Content may not be used for trademarks or service marks, or for any pornographic or unlawful purpose or use, or to defame anyone, or to violate anyone's right of privacy or publicity, or to infringe upon any copyright, trade name, trademark, or service mark of any person or entity.

Any derivative use of HotelsMapping Content is prohibited.

In no event may the HotelsMapping Content be sublicensed, re-licensed, rented or leased.

There shall be no archiving, republishing, transmission of HotelsMapping Content on any network or bulletin board, or for any other use by anyone other than the Authorized Licensees, without the prior written consent of HotelsMapping.

Any use of HotelsMapping Content by an unauthorized user ("Unauthorized User") constitutes copyright infringement, entitling HotelsMapping to exercise all rights and remedies available to it under copyright laws around the world, such as an injunction preventing further use or monetary damages, including claims by a third party.

3. Use of the Site

HotelsMapping Content and the site are intended for HotelsMapping customers. The Site or the HotelsMapping Content may not be used for any purpose other than your business with HotelsMapping. In particular, you are not permitted to:

(a) download, copy, or re-transmit any or all of the HotelsMapping Content without a license or agreement written with HotelsMapping;

(b) use any data mining, robots, or similar methods for gathering or extracting data;

(c) alter, manipulate, or otherwise display the Site or HotelsMapping Content through the use of framing or similar navigational technology;

(d) register, subscribe, unsubscribe or attempt to register, subscribe, unsubscribe any party for any HotelsMapping product or service without the express authorization of that party;

(e) modify, alter or reverse engineer any portion of the Site or the HotelsMapping Content;

(f) attempt to circumvent, disable, or interfere with security-related features of the Site or any system resources, services, or networks connected to or accessible through the Site;

(g) to sell, license, lease, or otherwise commercialize the HotelsMapping Content, or the Site, in any way without explicit written permission from HotelsMapping; and

(h) use the Site or the HotelsMapping Content otherwise than as intended. Such unauthorized use might also be in violation of other laws, including without limitation copyright and trademark laws, laws of privacy and publicity, and applicable communication statutes and regulations.

4. Liability Limitation

In no event shall HotelsMapping, its directors, members, employees or agents be liable for any direct, special, indirect or consequential damages, or any other damages of any kind, including but not limited to loss of use, loss of profits or loss of data, whether in an action in contract, tort (including but not limited to negligence) or otherwise, arising out of or in any way connected with the use of the site, the services, the HotelsMapping content or the materials contained in or accessed through the site, including without limitation any damages caused by or resulting from reliance by user on any information obtained from HotelsMapping, or that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission or any failure of performance, whether or not resulting from acts of God, communications failure, theft, destruction or unauthorized access to HotelsMapping’ records, programmes or services. In no event shall the aggregate liability of HotelsMapping, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory, arising out of or relating to the use of the site exceed any compensation you pay, if any, to HotelsMapping for access to or use of the site.

5. Termination

HotelsMapping reserves the right to terminate your account and/or block your use of the Site without notice and at its sole discretion.

6. Miscellaneous Provisions

Any waiver of any term of the Site Terms must be in writing and signed by HotelsMapping. Wherever possible, if any of these Site Terms were found to be unenforceable, this would not affect any other clause and each would remain in full force and effect. We reserve all rights not expressly granted herein.

7. Changes to Site Terms

HotelsMapping reserves the right to make any changes to the Site Terms at any time and at its sole discretion. Those changes will become effective immediately upon being posted on the Site. Your continued use of the Site following the posting of changes will constitute your acceptance of such changes. Each time you visit one of our websites, we encourage you to review the Site Terms.

8. Privacy and Cookies

9. Prohibited Uses

The Site must not be used in any way that diminishes, damages, or harms it in any way, or that violates any applicable rules and regulations.

It is not permitted to use any automatic device, process, or any other method to access the Site for any purpose, including monitoring or copying its content, or launching any viruses, trojan horses, worms, or other malicious software.

We may report the above activities to the authorities and we will coordinate with them by disclosing any of your data. In any event of breach, your right to use the Site will be terminated immediately.
